Welcome to Jiwe IO! By accessing or using our platform, you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully. If you do not agree, you may not use our platform.

1. Introduction

Jiwe IO ("we," "us," "our") is a platform designed to support African creatives and gamers by providing tools for hosting, crowdfunding, and community engagement. These Terms and Conditions ("Terms") govern your use of our platform, website, and related services.

2. User Accounts

• Account Creation: Users must provide accurate, current, and complete information when creating an account. You are responsible for updating your account information to ensure it remains accurate.
• Eligibility: You must be at least 18 years old to create an account. Users under 18 require parental or guardian consent.
• Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use.

3. Content Ownership and Use

• Ownership: Creators retain ownership of all content they upload, including games, comics, and 3D art.
• License to Jiwe IO: By uploading content, you grant Jiwe IO a non-exclusive, worldwide license to display, distribute, and promote your content within the platform.
• Prohibited Content: You may not upload content that is offensive, illegal, infringes on intellectual property rights, or violates community guidelines.

4. Payments and Transactions

• Fees: Jiwe IO charges a 5% fee per transaction and a 2.5% interchange fee for onboarding or off-boarding funds. These fees may change with prior notice.
• Payment Methods: We support mobile money, credit/debit cards, and cryptocurrency (Celo) to facilitate transactions.
• Refunds: Refunds for purchases or contributions are subject to the policies of the respective creator. Jiwe IO is not responsible for handling disputes between users and creators.

5. User Conduct

• Respect others within the community.
• Avoid uploading or sharing content that is fraudulent, harmful, or violates any laws.
• Refrain from engaging in activities that disrupt platform operations or infringe on the rights of others.

6. Termination of Accounts

• Termination by Jiwe IO: We reserve the right to suspend or terminate accounts for violating these Terms or engaging in prohibited activities.
• Voluntary Deactivation: Users may deactivate their accounts by contacting support. Note that some data may remain for legal or operational reasons.

7. Liability and Disclaimers

• Limited Liability: Jiwe IO is not liable for any damages arising from platform use, including but not limited to loss of data, revenue, or reputation.
• No Guarantees: While we strive for seamless operations, we do not guarantee uninterrupted access or success for creators using our platform.

8. Privacy Policy

Your use of Jiwe IO is also governed by our Privacy Policy. This document outlines how we collect, use, and protect your data.

9. Intellectual Property

• Jiwe IO Assets: All branding, logos, and trademarks are the property of Jiwe IO. Unauthorized use is strictly prohibited.
• Third-Party Rights: Users may not upload or use content they do not own or have the right to use.

10. Modifications to the Terms

Jiwe IO reserves the right to update these Terms at any time. Users will be notified of significant changes through email or platform notifications. Continued use of the platform constitutes acceptance of the updated Terms.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Constitution of Kenya 2010. Any disputes shall be resolved through mediation or arbitration, as agreed upon by the parties involved.
